Employment Law

Employment law is a complex and vast area of law that is constantly evolving and changing. In essence employment law aims to regulate the relationship between employers and employees by achieving a fair balance between the rights and obligations of both respective groups. Changes to employment law are developed to keep pace with the shifting relationship dynamic of employers and employees. Also, such changes are developed to adjust the ‘employment relationship’ for the benefit of the wider economy and society as a whole.

We understand at J.D. Spicer & Co that it is fundamental for both employers and employees to be well informed of these changes. Furthermore, to understand the impact of any changes upon existing employment law practises that govern the ‘employment relationship’.

Many of us at some stage within our lives, in our capacity as either employers or employees, will experience contact with employment law. Therefore, it is essential for both employers and employees to be able to consult with reliable resources to up date their knowledge of current employment law practices and to resolve any issues before they turn into disputes. At J.D. Spicer & Co we aim to offer a cost effective consultative service to both employers and employees that can avoid the expenditure of unnecessary legal costs; As often prevention is better than a cure.

The inherent nature of the relationship between employers and employees is defined by mutual trust and confidence. Sometimes there may be a breakdown of such trust and confidence, which can lead to disputes occurring. Upon being instructed by either party to a potential dispute we aim to offer clear advice without legal jargon to assist in a conciliatory manner. If the issues in dispute cannot be resolved via negotiation, then we are able to vigorously represent our clients’ interests. We always aim to put forward the best position on behalf of clients with a view to achieving successful outcomes.

We are able represent both employers and employees in the following areas of employment law:

  • Advice upon transfer of undertakings and Protection of Employees regulations
  • Unfair and wrongful dismissal
  • All types of discrimination including sex, race, disability, age, religious and sexual orientation discrimination
  • Redundancy payments
  • Unlawful deduction of wages
  • Bullying and harassment at work
  • Advising on employment contracts, policies and staff handbooks including sickness, grievance and disciplinary procedures
  • Advice upon “family friendly” rights including maternity and paternity pay and leave
  • Advice upon compromise agreements and severance

We aim to offer a cost effective service. To this end, we work on behalf of our clients and charge via an hourly rate scheme and in certain cases upon fixed fees. Please telephone us for further details. Our charges are wholly transparent and accurate.

An alternative source of funding may be legal expenses insurance. If you have an existing household and/or car insurance policy you may have a provision included for legal expenses with reference to employment law disputes. This may provide you with an invaluable source of funding. Please note that certain insurance policies with legal expenses insurance specifically exclude employment law disputes. We will be more than happy to check the terms of your insurance policy and to make enquires on your behalf to ascertain whether you are entitled to rely upon your legal expenses insurance. If so, we will communicate with your express authorisation with your insurers to organise your funding.
