Absolute Discharge: New Driver Successfully Avoids Revocation of Licence Through Special Reasons
Our client instructed us to represent him in relation to a No Insurance offence to which he had pleaded guilty. As a newly qualified driver, he was at risk of his licence being revoked under the new driver provisions: receiving six or more penalty points within the first two years of driving would have resulted in an automatic revocation of his licence and the need to retake both parts of the driving test.
We successfully demonstrated that our client had a reasonable belief that valid insurance was in place. We provided the court with evidence showing that he had been the victim of an insurance scam.
The court accepted our submissions and granted an absolute discharge.
As a result, our client was able to retain his licence and continue working in the construction industry, where he relies heavily on being able to drive.
