No Further Action - Theft (Shoplifting) Islington Police Station
Our client was arrested for the offence of Theft and taken to Islington Police Station.
The allegation against our client was that he was involved in a theft from a Boots store
For someone to guilty of theft, the following statutory wording must be satisfied as defined by section 1 of the Theft Act 1968, where a person must show that he dishonestly appropriated property belonging to another with the intention to permanently deprive the other of it.
If a person can show that they had a genuine belief that they had the legal right to appropriate the property; the owner would have consented; or the owner cannot be discovered by taking reasonable steps, you would then be able to raise a defence to the offence of theft.
On arrival at the police station, the representative from our firm met with officers who were assigned this particular matter. The representative from our firm and officers went into a private room to go through the evidence against our client. Our representative quizzed officers and obtain all information relevant to the case against our client. Officers had not provided much evidence and did not state whether CCTV footage had been obtained. It is important to note that this stage of the attendance is called disclosure between solicitor/legal representative and the officers who have been assigned to interview you and without a solicitor/legal representative you will not know what evidence there is against you that is why it is crucial that you always ask for a legal representative or solicitor to avoid the protentional ramifications that may occur later on in proceedings.
After our legal representative/solicitor had disclosure with officers, it was time to take provide our client with the disclosure provided so that we could cross reference it with our clients instruction in order to provide the specialist advice. Based on our clients instructions, our client was advised to provide answer ‘no comment’ to all questions put forth in interview, this was because our client had denied the allegations and the evidence presented by officers was weak in our view. This advice was provided by weighing the pros, and cons and on this occasion our advice prevented our client from any self-incrimination and by leaving officers to strict proof due to lack of evidence.
Due to our strategic approach at the police station our client was no further actioned.
