Application To Remove Driving Disqualification Early - Thames Magistrates Court

Mr Jonathan Lynn, one of our most senior and experienced criminal defence solicitors, attended Thames Magistrates Court on 26th February to represent a privately paying client in their application to remove their driving disqualification.

Our client was convicted on 13th October 2022 of driving under the influence of alcohol on 27th September 2022 and was handed a three-year driving ban and a fine .  

Under the Criminal Procedure Rules 2020, a Defendant can make an application to remove their disqualification from driving once they have served two years of their driving ban where the ban was for less than four years. Different time periods apply to longer bans.

On this basis, Mr Jonathan Lynn prepared an application under section 42 of the Road Traffic Offenders Act 1988 detailing submissions as to why our client’s disqualification should be terminated ahead of its Court ordered expiration. Mr Lynn arranged and served a bundle of documents supporting the application..  Mr Lynn’s submissions were that whilst our client was still remorseful and felt he deserved his punishment, his family and medical circumstances gave rise to a just reason for early removal of his disqualification.

Mr Lynn’s submissions were successful in Court and our client left Court having had his driving ban removed.
