Client Found Not Guilty of Serious Domestic Abuse Allegations After 9-Day Crown Court Trial
Allegations involving rape, domestic abuse, controlling behaviour and strangulation are some of the most serious offences dealt with by the police and courts. A conviction can result in a lengthy prison sentence, severe reputational damage, family breakdown and long-term restrictions on a person’s liberty.
JD Spicer Zeb represented a client who faced numerous serious allegations made by his wife. After a contested 9-day Crown Court trial, our client was found not guilty of all counts.
Serious Allegations, Full Acquittal
Our client was accused of multiple counts of rape, controlling and coercive behaviour, intentional strangulation and threats to kill. The complainant alleged that, throughout the marriage, our client had assaulted her, forced her to have sex, controlled her finances and monitored her phone.
The prosecution’s evidence included a detailed video-recorded police interview from the complainant outlining the history and severity of the facts. Our client denied the allegations from the outset and gave a full commented interview when questioned by the police.
During the proceedings, our client was initially remanded in custody. A bail application was later made and he was granted bail while awaiting trial.
The final outcome was : not guilty on all counts.
A High-Risk Case With Life-Changing Consequences
These were serious allegations carrying the risk of a substantial prison sentence if our client was convicted.
The prosecution case included detailed allegations about the relationship, the couple’s private life, financial arrangements and alleged attempts to influence the complainant through family members. The case required careful preparation because the court would have to consider not only what was said, but also the wider context of the marriage.
Our client’s position was that the allegations were fabricated. He explained that the relationship had broken down after difficulties in the UK, including financial pressure, poor living conditions and dissatisfaction within the marriage.
Focused Preparation and Strategic Evidence
JD Spicer Zeb took detailed instructions from the client and carefully analysed the evidence in the case.
The defence case was that the relationship had involved consensual intimacy and that our client had not assaulted, strangled or controlled the complainant as alleged. He also denied financially controlling her. Importantly, parts of the financial evidence, including bank material, supported his position.
Tactical disclosure requests were made to obtain further material relevant to the defence. We also considered the wider background, including the suggestion that the complainant had a motive to make allegations in order to access support with housing and funding following separation.
An expert was carefully selected and instructed to assist with understanding the true meaning and context of certain evidence disclosed by the complainant.
JD Spicer Zeb Solicitors prepared the case and instructed a barrister to represent the client at trial in the Crown Court.
Freedom, Reputation and Future Protected
A conviction would have had devastating consequences: imprisonment, damage to reputation, separation from family, immigration and employment difficulties, and long-term restrictions following release.
Instead, after a 9-day trial, the jury returned verdicts of not guilty on all counts. Our client left court without convictions for these extremely serious allegations.
A defence costs order was also made in our client’s favour.
Serious Criminal Allegations Require Serious Representation
This case shows the importance of early preparation, careful evidence analysis and strong Crown Court advocacy in serious sexual offence and domestic abuse cases.
JD Spicer Zeb represents clients facing allegations of rape, controlling and coercive behaviour, intentional strangulation, domestic abuse and other serious criminal offences. Where the stakes are high, our team works to protect our clients’ liberty, reputation and future.
