Crown Court Grants Bail Variation After Refusal by National Crime Agency and Magistrates' Court

Our client had been released on police bail by the National Crime Agency in connection with allegations of money laundering, both within and outside the UK’s jurisdiction. His bail conditions required him to reside at his home address, surrender his passport, and refrain from contacting co-defendants directly or indirectly.

After five months of full compliance with these conditions, we submitted a request to the National Crime Agency seeking a variation of bail to allow the temporary return of his passport. This was to enable him to attend his child’s wedding abroad. In support of the application, we provided comprehensive documentation, including flight bookings, venue details, and a full itinerary.

The request was refused. The National Crime Agency indicated that they were working to submit the case file to the CPS for a charging decision and stated that, as the requested travel fell outside the current bail period, it would not be appropriate to agree to or oppose the variation at that time. They also noted their intention to seek an extension of bail.

Following this refusal, we made an application to the Magistrates’ Court to challenge the decision. To strengthen the application, we proposed the addition of a financial surety to mitigate any perceived risk. Despite our submissions, the application was opposed by the National Crime Agency and ultimately refused by the bench, citing the seriousness of the allegations, the sums involved, and our client’s previous criminal history.

We subsequently exercised our right to appeal to the Crown Court. At this hearing, further objections were raised, including concerns that the destination country may have links to the alleged offences. In response, we worked closely with our client to enhance the proposed surety and reinforce the safeguards surrounding his travel.

After careful consideration, the Crown Court Judge granted the application and approved the bail variation.

This outcome enabled our client to attend his son’s wedding, a significant, once in a lifetime family event. His presence was of profound emotional importance to both him and his family. Throughout the duration of his bail, our client remained fully compliant with all conditions, demonstrating his understanding of the seriousness of the matter and his willingness to abide by the legal process.
