Birmingham Magistrates Court - Breach of SHPO - Conditional Discharge
Our client was subjected to a Sexual Harm Prevention Order (SHPO) with stringent conditions within the order. Like many sexual offence cases those convicted are subjected to a SHPO. Our client had breached the following condition which resulted him being charged for breaching the SHPO and his suspended sentence order.
- Unsupervised contact with any child under the age of 16
Our client had not disclosed his conviction to the female and had contact with her children which resulted in our client being charged with the breach.
Mr Cholera reviewed the initial details of the prosecution case and attend upon our client prior to attending Birmingham Magistrates court to take his in-depth instructions. Our client admitted to the breach and was advised by Mr Cholera who also ensured that our client was properly prepared for court and ensured he had all the information required for mitigation.
On the day of the hearing Mr Cholera attended Birmingham Magistrates court with our client for his first appearance, our client pleaded guilty and Mr Cholera eloquently put forward all of our clients mitigating circumstances to the court. The court heard our submission and our client was sentenced accordingly.
The judge was persuaded not to activate the suspended sentence and sentenced our client to a 12-month conditional discharge due to his personal circumstances and his previous compliance of his community order, the court also ordered our client to pay a £21 victim surcharge and the court made no order for costs.
In relation to the breach of suspended sentence the court took no action.
