Man Not Guilty of Drunk and Disorderly In a public place Highbury Corner Magistrates Court 2025

Our client was charged with Drunk and Disorderly in a public place, contrary to section 91.

It was alleged that our client was observed to be intoxicated and shouting at members of staff, threatening to cause the station to be evacuated prior to the police arrival. It was also alleged that the defendant began to abuse officers, shouting and swearing at them using profanities on several occasions.

Our clients instructions were that he denied being drunk and disorderly and that he encountered the officer on the outside of the train station upon being told to leave. He informed the officer that he was on the way to the underground which was 30 metres away with a marked line on the pavement from the location of where he was standing to the entrance of the underground station. Our client informed the officer that he was organising his belongings to go into the underground station and the officer has stated that your not going that way and had arrested him. 

Solicitor Jonathan Lynn was instructed to represent the client at a summary trial at the Magistrates Court. The Crown put forward their case, however they had no witnesses when the case was called on. The Crown applied for an adjournment and that was refused, they then offered no evidence and as a result the client was acquitted.
