Prosecution offer no evidence:- Breach of Restraining Order Wood Green Crown Court June 2023

Our client was charged with breach of a restraining order resulting from an original conviction in 2017. A short while after this the defendant allegedly took to Facebook and posted a status with reference to the persons for whom the restraining order protected. Our client was not arrested until 2023 following an execution of a warrant.

The subjects of the restraining order were a Senior Crown Prosecutor from the Crown Prosecution Service (CPS) and a criminal defence solicitor. The CPS were keen to pursue this case despite it being over 6 years old and the matter proceeded to Wood Green Crown Court. Despite strong evidence against the client, she was advised not to enter a plea as representations would be prepared on whether prosecution is in the public interest. Representations were put forward by the defence on the client’s behalf and eventually the CPS agreed it was not in the public interest and formally offered no evidence.

The client’s life had significantly changed from 6 years ago and had she entered a guilty plea or be found guilty a custodial sentence would have been the likely outcome. With the assistance of our solicitors and counsel the client is now free to put this incident behind them and continue with the progress they have made in life.
