JD Spicer Zeb Succesfully Oppose Domestic Violence Protection Order Magistrates Court

We were instructed by a professional on Saturday morning to engage our services in resisting a full domestic violence protection order sought by the police against them.  

Domestic Violence Protection Notices (DVPNs) can be issued by police when attending incidents of alleged domestic violence.

The DVPN can remove the recipient from the property for 48 hours. The police can then apply to the Magistrates to extend this period for 14 to 28 days.

We took our client through our onboarding procedure and agreed to private terms to appear at Highbury Corner Magistrates Court on Monday morning.

We read the bundle of papers issued by the police on Sunday and took our client's instructions as soon as the court opened on Monday morning at 9 o'clock.

The police made a strong application for a domestic violence protection order, which we resisted.

Our client gave evidence, and our advocate cross-examined the officer.

Following our submissions, the court was not satisfied that a domestic violence Protection order against our client was necessary. Our client was delighted with the outcome. 

Our service included providing full written advice on the law on Sunday afternoon so that our client fully understood the relevant provisions and the law.
