Case dismissed Common Assault - Manchester Magistrates 2022

Our client was charged with a s39 assault by beating, after apprehending the victim who had previously trespassed our clients home address. Whilst trying to apprehend the victim he suffered a cut to his head which required stitches. We advised our client on self defence which is an established defence to the offence. Our client opted to instruct us privately and for Edgar Fernando to represent him at his summary trial. Edgar Fernando made submissions of no case to answer after witnesses for the prosecution gave vague and unreliable evidence, the case was then dismissed. The case was dismissed as the court accepted that there was no case to answer and the prosecutions case had been discredited.
