What is the police guidance on speeding offences?
Police enforcement of speeding offences follows national guidance and strict operational procedures. Officers and camera enforcement teams are expected to comply with their force’s Code of Practice when using speed detection equipment. This is governed by the updated 2011 Association of Chief Police Officers (ACPO) Code of Practice.
Under these guidelines, any radar or camera device, such as speed cameras or handheld speed guns, should be properly calibrated, regularly checked for accuracy, and operated by a trained officer. If these procedures are not followed, the reliability of the evidence may be open to challenge.

Originally published in 2004 and later updated in 2011, the Code sets out clear standards for the operation, calibration, and maintenance of speed detection equipment. It also outlines the necessary training for officers who use these devices.

How does the law deal with speeding motorists?
Speeding is treated as a serious motoring offence, and the law provides clear penalties depending on the circumstances. Most cases are dealt with by way of a Fixed Penalty Notice (FPN), which typically results in a minimum £100 fine and three penalty points on your driving licence. If you plead not guilty to a Fixed Penalty Notice, your case will proceed to court.
For more serious speeding offences, such as excessively high speeds or repeat offending, you may not be sent an FPN; instead, you will be sent a letter to attend court.
It is important to note whether you have pled not guilty to an FPN or been asked to attend court, the court has the discretion to impose harsher penalties, including higher fines, increased penalty points, driving disqualifications, or even custodial sentences in extreme cases. If you are found guilty, the severity of the penalty will depend on how far over the speed limit you were driving and any aggravating factors.
