R v J S Not Guilty Assault Police - 2018

We acted on behalf of a 21 year old female who was alleged to have assaulted a police officer by violently grabbing him around the throat. The officer along with another were tasked to secure a patient who had sustained serious injuries. We advanced our clients defence that the officer was not acting in the execution of their duty.  Our client strongly denied the allegation and had no previous convictions.  Our clients job required enhanced criminal record checks. A conviction would have meant her losing her employment and ultimately having a detrimental affect on any future employment. Our experienced team made numerous applications to the Court regarding the lack of disclosure and ultimately the prosecution offered no evidence and our client was found not guilty.
