Successful Written Representations to the CPS to WIthdraw Charges Highbury Corner Magistrates Court September 2025
We made successful representations to the Crown Prosecution Service (CPS) on behalf of a client who was charged with two counts of assault by beating contrary to section 39 of the Criminal Justice Act 1988.
This was a case concerning incidents that occurred on a Northern Line tube service. Our client had assaulted two women, one on board the train and one just outside the station. The prosecution case relied on recorded footage of the incidents and several witness statements, both from the two women involved and from members of the general public who witnessed the incidents.
There was a realistic chance of conviction based on the evidence however our client was struggling with a mental health diagnosis at the time and since the time of the incident had received the care he needed. Due to his newfound stability, we made representations to the CPS asserting it was not in the public interest to prosecute. We submitted that a custodial sentence would result in our client becoming a risk to himself and therefore a longer term risk to the public.
The CPS responded to our submissions and agreed to withdrawal the charges against our client as we were able to demonstrate that it was not in the public interest to pursue a conviction.
We regularly make representations to the CPS if there is a lack of supportive evidence or if a conviction is not in the public interest.
