Suspended Sentence - Sexual communication child Birmingham

Suspended Sentence – Magistrates Court – Our client was charged with attempted sexual communication with a 13-year-old child under  Section 1 (1)Criminal Attempts Act 1981. The police were participating covertly on a platform and no actual child existed.

The starting category was one of B2 with a starting point of 36 weeks imprisonment with a range of 26 weeks to 1 year 6 months imprisonment.

We advised on the strength of the evidence and advised our client to enter an early guilty plea to benefit from a maximum early plea sentence discount.

We prepared the case for the sentencing hearing and prepared full mitigation. We gathered all the evidence in support of our client’s personal mitigation including references.

After full mitigation, the client was sentenced to 4 months imprisonment suspended for 24 months with a requirement to complete 30 days of Rehabilitation Activity Requirement and 100 hours of unpaid work.
