Domestic ABH Allegation - No Further Action Taken Following Expert Legal Representation - Wembley Police Station (May 2025)

Our client faced an allegation of Actual Bodily Harm (ABH) made by his partner, resulting in his arrest. It was alleged that our client struck his partner, causing a cut to her brow. However, our client strongly denied the allegation, maintaining that he was, in fact, the victim in the incident.

Under Section 47 of the Offences Against the Person Act 1861, the prosecution must prove that the accused intentionally or recklessly assaulted another person, thereby causing Actual Bodily Harm. The term "bodily harm" is interpreted to include any injury that interferes with the victim’s health or comfort and must be more than transient or trifling (R v Donovan [1934] 2 KB 498).

There are several legal defences to a charge of ABH, including self-defence, duress, necessity, and consent. In this case, our client raised a factual denial, giving an alternative version of events that contradicted the police's account.
