London Executive Cleared of False Rape Allegation Following Work Night Out - (Wood Green Crown Court - October 2025)

Background: The Night in Question
Following a work party, our client and two colleagues accompanied the complainant back to her flat. Alcohol consumption continued at the flat, after which one of the men left, leaving our client and the complainant alone.
Given the late hour and difficulty arranging transport, our client was permitted to sleep on the sofa at the complainant’s flat, as he needed to be at work the following day.
During the night, our client woke up and used the only ensuite bathroom located in the complainant’s bedroom. After using the bathroom, the complainant asked him if he would be getting into bed with her. This led to a brief, consensual sexual encounter, involving foreplay and some low-level intercourse. They then both fell asleep in the same bed.
When the complainant woke up later, she spoke with her flatmate, telling them that there was a man in her bed. Our client was asked to leave abruptly. He returned home, unaware of the accusations that would later follow.
The Allegation
After the incident, our client was contacted by his employer and called into an HR meeting, where he was suspended from work. That evening, police arrived at his home, arrested him, and conducted a formal interview.
Our team was instructed immediately. We advised our client to provide a full, truthful account of the events to the police. We ensured that a detailed statement was taken, covering all aspects of the night in question. A senior partner was engaged at once to oversee the case and offer guidance throughout the process.
Defence Strategy and Investigation
We reviewed all available evidence thoroughly, including statements from the prosecution and CCTV footage. Early disclosure of the CCTV footage from the prosecution did not show any flirtatious behaviour from the complainant, as had been suggested in her version of events.
However, upon careful scrutiny of the full, raw CCTV footage, our team uncovered multiple instances of flirtatious actions from the complainant that had not been highlighted by the prosecution. This footage, crucial to the defence, was not initially disclosed by the police.
Our Kings Counsel, Louise Sweet KC, an expert in defending serious sexual allegations, meticulously cross-examined the complainant during the trial. Her strategic questioning revealed numerous inconsistencies in the complainant’s testimony and undermined her credibility. This, coupled with the newly discovered CCTV footage, created significant doubt in the minds of the jury.
Outcome
The jury deliberated for just two hours before returning a verdict of not guilty, acquitting our client of all charges.
This case underscored a critical point: in 2025, police and prosecution teams still fail to disclose or properly highlight evidence favourable to the defence at early stages of investigation, such as during initial interviews or once CCTV evidence is available that does not support the complainant’s account.
