Minimum 7 year Sentence Disapplied- Crown Court May 2022

Stuart Lloyd and instructed counsel represented a client who had pleaded guilty to Class A drug supply offences. Section 313 of the Sentencing Code imposes a minimum sentence of 7 years for any person who is being sentenced for their third strike in relation to Class A drug supply.

Stuart Lloyd instructed an expert in this matter to assess the client and following on from this, representations were made that the minimum sentence should not apply in the client’s situation. Following successful submissions from counsel Tobias Smith of 25 Bedford Row the minimum sentence was disapplied and the client was sentenced to 40 months imprisonment.
