Production of class A & B drug - Suspended Sentence 2023

James O’Donnell represented a defendant charged with production of class A (magic mushrooms), class B ( cannabis), along with a number of other charges. 

He was arrested following a drugs act warrant at his home address where the police uncovered what they described as a large scale drug operation. 

The prosecution’s case was that this was an operation to produce drugs on a commercial scale for onward supply with a starting point of 5 years custody on the sentencing guidelines. 

Our counsel drafted a detailed defence case statement which resulted in the prosecution reviewing the case fully and accepting a basis of plea. The prosecution accepted that our client produced the drugs but only for his own use. He received a suspended sentenced order and avoided any confiscation proceedings.
