Successful written representations for an out of Court disposal - Lewisham Police Station 2025

Our client, who lives in the Far East, was arrested at Heathrow Airport due to an allegation regarding Assault occasioning actual bodily harm and Malicious Communications.

We were instructed privately by the client who was restricted from returning to his home and place of work due to the ongoing Police investigation. We acted expeditiously and considered the evidence to establish that a charging decision was imminent. Upon our client’s instructions we wrote written representations to the Police requesting that a conditional caution be given in favour of prosecution, as to allow for our client to return home. These were successful and our client therefore avoided prosecution for ABH and Malicious Communication. Were our client to have been charged the matter would have gone to trial, possibly taking years to resolve.

The result of our written representations was that our client’s matter was resolved outside of Court and a caution was given for Malicious Communications. No further action was taken in relation to the Assault offence.  Thus, our client has been able to return home and continue with his life.
