About

No Further Action Domestic Common Assault and Criminal Damage - Wembley Police Station (September 2025)

The allegation against our client was that he attacked his mother by throwing a mug at her and subsequently broke her phone. The police stated that his mother did not provide a victim statement and did not wish to support the case. Our client did not provide any instructions during the consultation so our expert lawyer had to advise him based on the evidence at hand.

For our client to have been charged with common assault, the police would need to demonstrate a realistic prospect of convicting our client of inflicting violence on his relative or making them think they were about to have violence inflicted upon them.

For our client to have been charged with criminal damage, the police would need to prove that damage was caused to the victim’s property and that our client intended to do so or was reckless.

When attending Wembley Police Station, our expert lawyer was able to assess the evidence available at the time. The advice given to answer ‘no comment’ to police questions allowed him to prevent self-incrimination and put the police to strict proof. This advice led the police to take no further action and prevent the matter from going to court.

We represent clients at the Police Station on a 24-hour basis 7 days a week. We have experts dealing with all types of offences and sexual offences. We are highly regarded as leading, and specialist sexual offence defence solicitors having achieved many successful outcomes.
