Highbury Corner Magistrates Court - Client Acquitted and Restraining Order Refused (October 2025)
Our client was charged with an offence of criminal damage under sections 1(1) and 4 of the Criminal Damage Act 1971. It was claimed that our client, without lawful excuse, caused damage to a motor vehicle valued under £500 belonging to the complainant.
The complainant reported a long scratch along the rear of his vehicle, allegedly caused with a small object such as a key. CCTV footage appeared to show a male, identified by the complainant as his neighbour, scratching the vehicle before entering a white van. Police checks linked the van and address to our client, who was listed as both a resident and the vehicle’s registered keeper.
Officers initially sought to offer a community resolution; however, our client denied the allegation and declined to participate in a voluntary interview. He was subsequently charged to attend Highbury Corner Magistrates Court.
We were appointed by the court, having been approached by the client as the duty solicitor, to represent him at trial and cross-examine the prosecution witness. Our client had no previous convictions and strenuously denied the allegations from the outset.
Our defence team undertook a detailed review of all available evidence and prepared thoroughly for trial. During proceedings, our senior solicitor rigorously cross-examined the complainant, testing the reliability and accuracy of the identification evidence.
Following the close of evidence and deliberation, the Bench returned a verdict of Not Guilty, acquitting our client of all charges. An application for a restraining order was also made by the prosecution but was refused by the court.
